We share an interesting article from Innovarte ONG, written by Adán González, about licenses of right, a type of voluntary licenses established in some European countries such as Spain and Germany (art. 87 and following of Law 24/2015, of July 24, Spain and section 23 of the German Patent Law).
Its main characteristics, Spanish procedure and the advantages offered by this type of licenses to patent holders as well as licensees are presented.
The article also highlights that the implementation of a full-fledged licensing system in Chile could bring significant benefits in the field of public health and technologies that can benefit a broad spectrum of the population. “This voluntary model would facilitate the diffusion of medical and technological innovations, allowing medical devices, drugs and other crucial advances to be more quickly available for widespread use.”
